General conditions of Sale

These general conditions govern the methods of sale of the products on the animosi.it website.

All contracts for the sale of Products by Animosi Luciano Illuminazione Srl to third parties are governed by these General Conditions, which form an integral and essential part of every proposal, order and purchase order confirmation for the Products themselves. The conditions of sale are those in force on the date of the order.

1. Products: prices and features

Unless otherwise indicated, the prices of the Products published on the animosi.it website are expressed in EURO (€) and include 22% VAT. Shipping costs are excluded unless otherwise indicated.

Shipments outside the European Community (extra EU) are also net of any customs duties, which will be borne by the recipient and will be requested by the shipper during the delivery phase.

The prices of the Products published from time to time on the animosi.it site cancel and replace the previous ones and are subject to the actual availability of the Products.

The technical and functional characteristics relating to the Products, published on the animosi.it website in the internet pages describing the articles, are those communicated by the respective manufacturers. Animosi Luciano Illuminazione Srl assumes no responsibility for the truthfulness and completeness of such information. The images of the products are indicative and not binding.

Although our operators can give indications on the characteristics of the Products, the Customer is responsible for the choice of the Products ordered and for the correspondence and conformity of the specifications indicated by each manufacturer to their needs.

2. Orders - billing

Orders can be placed upon registration and / or creation of a personal account of the Customer. We therefore remind you to carefully read the Privacy Policy on the site.
Each order of Products sent through the animosi.it site constitutes the Customer's contractual proposal. The fulfillment of the order by Animosi Luciano Illuminazione Srl is equivalent to confirmation and acceptance of the same.

The fiscal documentation relating to the ordered Products will be issued by Animosi Luciano Illuminazione Srl at the time of shipment of the same to the Customer.

3. Execution of the order

The order will be executed within the terms specified on the Site.

Once confirmed, the order can be canceled within 24 hours. In compliance with the relevant laws, the customer can still return the order within 14 days, following our Return Policy.

In case of non-execution of the order by Animosi Luciano Illuminazione Srl (if the same is due to unavailability of the Products ordered by the Customer), Animosi Luciano Illuminazione Srl will as soon as possible inform the Customer of the expected delivery times for the supply of the missing Product. If the Customer does not intend to wait for this time, in any case not exceeding 30 working days, Animosi Luciano Illuminazione Srl will reimburse any sums already paid by them for the supply not performed.

In case of breakage, out of stock or unavailability of the ordered Product, Animosi Luciano Illuminazione Srl undertakes to inform the Customer as soon as possible and to specify a deadline for availability.

The Customer will confirm his choice by e-mail, i.e. wait for the availability of the Product or request a refund.

4. Acceptance of the order

The conclusion of the contract will take place only upon confirmation of the order by Animosi Luciano Illuminazione Srl
The Customer will receive by e-mail a notification of receipt showing the order confirmation with all the constituent elements of the contract (products ordered, prices, indicative delivery dates, shipping costs, ...).

Animosi Luciano Illuminazione Srl reserves the right not to confirm an order for any reason relating in particular to a problem concerning the order received or the supply of Products.

5. Payment

The payment of the consideration is due at the time of the order.

The Customer undertakes to pay the agreed price for the Product ordered on the Site (price of the Products and transport) as well as, if necessary, to pay the VAT or other taxes relating to the import directly to the courier or carrier. of the Products in the countries where the delivery will take place.

The forms of payment accepted on the animosi.it site are as follows:

- bank transfer in favor of Animosi Luciano Illuminazione Srl In case of non-receipt of the copy of the transfer within 2 (two) days following the confirmation of the order, Animosi Luciano Illuminazione Srl reserves the right to cancel the order. 6. Non-payment - Retention of title

The ordered Products remain the property of Animosi Luciano Illuminazione Srl until the final and full payment of their price (pursuant to Art. 1523 and following of the Italian Civil Code).

7. Delivery of Products

The Products are delivered to the address indicated by the Customer.

The shipments will take place after receiving confirmation of payments: for the bank transfer the crediting to our current account is valid, for the payment by credit card the confirmation of the transaction by the circuit.

For our shipments we rely on the service of qualified express couriers such as Bartolini, SDA, GLS, DHL or other specialized couriers depending on the delivery location.

8. Availability and delivery times

The delivery times shown in the product sheet are indicative.

When the products are available in stock they are shipped in 1/2 working days.

The products to be ordered are generally available in the warehouse in about 20 working days, times varying according to the manufacturing company.
In general, the timing may be subject to delays not dependent on the will of Animosi Luciano Illuminazione srl, which will inform its customers of any further expectations.

No responsibility can be attributed to Animosi Luciano Illuminazione Srl in case of delay in the delivery of the order

The shipping term of an order containing items with different delivery times is equal to the longer shipping term of the items in the order. Any delays in deliveries of less than 30 (thirty) days do not entitle the Customer to refuse delivery of the Products, nor to claim compensation or indemnities of any kind.

Normally deliveries take place within 2/3 days for Italy and 4/6 days for other destinations from the date of loading of the products to the courier. Shipping times are indicated in working days.

Deliveries are made from Monday to Friday from 9.00 to 18.00. The shipment of the product will be accompanied by a confirmation email containing all the references necessary to track the shipment.

The delivery document issued by the carrier, dated and signed by the Customer upon delivery of the Product, will constitute proof of transport and release of the goods.

Deliveries are to be intended exclusively at street level .

9. Receipt of products

Upon delivery, the Customer must check the content, compliance and status of the Product (s). Therefore, upon delivery, Animosi Luciano Illuminazione Srl recommends that the Customer proceed to check the status of the Products delivered before signing the acknowledgment of receipt, and to ensure in particular:

- that the number of packages delivered corresponds to what is indicated in the order confirmation;

- that the packaging is intact, not damaged, wet or otherwise altered, and to check the integrity of the contents.

If the Customer finds anomalies, he is obliged to refuse the delivery of the products or to put his reservations in writing in a detailed and dated document. If the courier's document is signed without affixing any "reserve", the Customer will not be able to make any objection about the external characteristics of what has been delivered. Any problems concerning the integrity, correspondence or completeness of the Products received must be promptly reported to customer service, in any case within 5 (five) days of delivery.

10. Return of the products in case of absence of the customer

In case of absence of the recipient during the delivery, the carrier will leave a notice of passage to the delivery address indicated by the Customer and will retry the delivery. In case of failure to collect within the deadline established by the carrier, the Products will be returned to Animosi Luciano Illuminazione Srl, which will return the goods to the customer only after he has paid the costs of storage and return of the products to the warehouse. Animosi Luciano Illuminazione srl reserves the right to reimburse the price of the Products, leaving the shipping costs to be paid by the Customer.

In case of incorrect Product shipment, the Customer undertakes to return said Product or Products concerned to Animosi Luciano Illuminazione Srl within 7 (seven) days of receipt, with the closed package, in their original state and packaging and with the accompanying documents. .

11. Force majeure

In addition to those normally considered by the jurisprudence, the following cases are explicitly considered as cases of force majeure:

- total or partial strikes, internal or external to the company, the blocking of means of transport or supply for any reason, governmental or legal restrictions, computer failures, blocking of telecommunications including networks and in particular the internet.

In the event of force majeure, the execution of the order will be suspended, initially, in full right.
If after a period of 3 (three) months and the parties ascertain the persistence of the case of force majeure, the order will be automatically canceled, unless otherwise agreed by both parties.

12. Product Warranties - Technical assistance

All products purchased on the animosi.it website are covered by an Italian 2 (two) year warranty.

The guarantee does not apply:

• to what is provided as a gift and on consumables (eg: light bulbs);

• for damage to the product resulting from incorrect installation or improper use of the product itself;

• for damage resulting from incorrect maintenance and repair operations.

The shipping costs for the return to stock of the products to be repaired under warranty are charged to the customer. Animosi Luciano Illuminazione srl will ship the repaired product to the customer at its own expense.

The products must be installed by specialized and qualified personnel.

13. Warranty and Liability

Animosi Luciano Illuminazione Srl guarantees only the material integrity of the Products at the time of delivery (hereinafter, the "Warranty Animosi Luciano Illuminazione Srl").

A - Any defects covered by the Animosi Luciano Illuminazione Srl Warranty must be reported by the Customer, under penalty of forfeiture, no later than 10 (ten) days from the delivery date. If the Animosi Luciano Illuminazione Srl Warranty is operative, the Customer will only be entitled to the replacement of the damaged Products upon return of the same, the Customer's right to compensation for any damage, even further, being excluded. Technical assistance and warranty interventions on the Products are carried out, where required, by the individual Manufacturers, according to the terms and methods indicated in the documentation attached to the Products themselves. In particular, Animosi Luciano Illuminazione Srl does not provide any guarantee regarding the compatibility of the Products with other Products or equipment used by the Customer, nor does it provide any guarantee regarding the suitability of the Products for the specific use intended by the Customer.

C - Without prejudice to the hypothesis of willful misconduct or gross negligence of Animosi Luciano Illuminazione Srl, it is henceforth agreed that, if the liability of Animosi Luciano Illuminazione Srl is ascertained for any reason towards the Customer - including the case of non-fulfillment, total or partial, the obligations assumed by the same towards the Customer through the animosi.it site as a result of the execution of an order - the responsibility of Animosi Luciano Illuminazione Srl cannot exceed the price of the Products purchased by the Customer and for which the dispute has arisen.

14. Right of withdrawal

• What's it about

The consumer has the right, within a period of 14 (fourteen) calendar days from receipt of the goods, to exercise the RIGHT OF WITHDRAWAL. This right consists in the right to return the purchased good to the seller and in the consequent refund of the purchase price.

• What excludes

The right of withdrawal does not apply to products sold by Animosi Luciano Illuminazione Srl, if the same has specifically ordered the product requested by the customer. Shipping charges are non-refundable. The shipping costs for the return are charged to the customer. Furthermore, this legislation does not apply if the purchase is less than 200 euros.

• How to make the return shipment

• Processing times for credit transfer of payment to the customer

15. Return of defective or non-compliant products

20. Integrity of the contract

21. Intellectual property
